Washington Enacts New Rules To Protect Outdoor Workers From Heat-Related Deaths

Updated heat protections for outdoor workers are now in effect in Washington state, aimed at safeguarding workers from heat-related illnesses and deaths. The Washington State Department of Labor & Industries (L&I) has implemented these formal updates, which cover outdoor, construction, and farm workers, and were put into effect on Monday, July 17.

Washington is one of the few states to have heat protections for outdoor workers, having initially established rules in 2008. The decision to update these regulations came in response to the increasing concern over worker safety due to the changing climate and rising temperatures.

In the past, there have been alarming instances of heat-related deaths in the state. Even more so, according to data from the Washington State Department of Health (DoH), there were 100 heat-related deaths between June 26 and July 2, 2021. In this situation, L&I had previously enacted temporary emergency heat rules in 2021 and 2022.

The new permanent rules now set a lower temperature threshold of 80 degrees Fahrenheit for taking action to protect outdoor workers. In light of this, specific guidelines have been established regarding drinking water, shade provision, and mandatory cool-down periods. Particularly, employers must closely observe workers and implement mandatory cool-down breaks of 10 minutes every two hours when the temperature reaches 90 degrees Fahrenheit, and 15 minutes every hour at 100 degrees Fahrenheit.
